Good Samaritan Protection

(a) A person who uses or tries to use an automated external defibrillator (AED) during what they believe is a medical emergency is not legally responsible for any harm caused by using or trying to use the device. However, this does not apply if they fail to notify emergency medical services.

(b) A person who owns or provides an AED for use in a medical emergency is not legally responsible for any harm caused by its use or attempted use. This protection does not cover situations involving gross negligence (serious carelessness).

(c) The legal protection mentioned in (b) does not apply to the company that manufactures the AED.
